Munich, October 2025 - The Löffler Property Group  Ltd. from Kammerstein near Nuremberg is facing a serious crisis. On 29 September 2025, the company filed for insolvency after the Federal Financial Supervisory Authority (BaFin) had ordered the repayment of all customer deposits. BaFin accuses the group of having carried out unauthorised deposit transactions. Many investors had invested their capital in the form of Subordinated loan which are particularly risky, as they are subordinated in the event of insolvency and may result in a total loss. The insolvency court in Nuremberg has jurisdiction (Ref.: IN 1409/25) and the law firm Dr Harald Schwarz has been appointed as the insolvency administrator. The proceedings are currently in preliminary insolvency proceedings.

BaFin's order led to the freezing of the Löffler Group's accounts, which ultimately resulted in the company filing for insolvency. Against managing director Jörg Löffler Investigations are underway on suspicion of Delayed insolvency and fraud. Whether and to what extent the business model of this company was at all viable must be examined; at least the high interest rate promises give cause for concern.

Rights for aggrieved investors

Investors who have invested in subordinated loans or other investments of the Löffler Property Group can Asserting claims for damages. Especially Investment advisor can be held liable if they do not fulfil their Duty to provide information violated in particular in the event of violations of the German Banking Act (KWG). Furthermore, this form of investment was never suitable for investors looking for a secure form of investment. The risks are particularly high with subordinated loans and in the event of insolvency.

Lawyer and specialist lawyer Dr Greger now recommends the following:

  1. Notification and representation of investors in insolvency proceedings and registration of the respective claims in the insolvency table. It is important here whether the claims are § 38 InsO or § 39 InsO claims (subordinated or not), as this determines whether the investors are treated equally to other creditors. Dr Greger's law firm has extensive experience in representing investors in insolvency proceedings (Wirecard, P&R Container, UDI). Subordination clauses are often invalid.
  2. Examination and enforcement of claims for damages against investment advisors/brokers for breach of duties to inform and advise. Violations of the KWG, no investment and investor-orientated advice.
  3. In addition, claims for damages against those responsible for the company may be considered, as BaFin believes that they have engaged in unauthorised deposit business
